Answer: First I'll assume your not financing the purchase, since that vehicle should cost about $50 :-p . It depends on where in Toronto you live and whether you have driver training or not. Assuming you live in the Dufferin/Bloor area you're looking at at $6,500 for just the basic liability with driver training and $8,200 without driver training. This is with you as the principal operator. Keep in mind living out in Etobicoke or North York would make it cheaper, but we're talking about maximum $150 difference.




Should I pay him or go through Insurance? I'm 100% liable?

Question: Got in a car accident in a different city.. need help on what to do? I'm 100% liable and it was my fault... I'm supposed to leave the province (Ontario in 3 days) for employment in Alberta. and just last week i had the bad luck of getting into a minor collision in Toronto(insane traffic on the 400 highways i'm not used to it)). I was coming off the highway 427 north and hit stopped car at a red light (near the ramp near burnhamthorpe) and the impact of my car made him hit the car in front of him. (I guess he stopped too closeley??) I was wasn't going faster than 30-40 kmph it was my fault i didn't break hard enough from back off the ramp. I had my camera with me so i got out my car and we exchanged drivers license information and decided the damage wasn't enough to call the police and get a report. We decided to settle this without dealing with insurance (we didn't get each others insurance information either... just drivers license i had a G he had a G2 and make/model of car) I took detailed pictures from my digital camera of his vehicle made him pop the trunk took pictures inside made sure there were no dents or dings on the body.. and got clear shots of the front and back bumper... so i figured it wouldn't be much just throw him a couple hundred bucks cash and that would settle it. (In the pictures it shows the no damage to the bumpers front and back just some bits of paints and scoff) so he leaves the scene and i leave the scene and pull over at gas station to examine my vehicle made sure no fluids leaking it was in drivable good shape no damage was done except 2 small crask in the front bumper and a ding in the steek frame no big deal car is drivable i can live with that so i drove home 3 hours. so i'm waiting for a call and i get a call from him 3 days later and he sends me an estimate of repair (from a DEALERSHIP) which was about 2100 bucks. apparently they need to replace both the front and back bumper of his car with new factory ones then refinish them blah blah.. i said that was ridiculous and asked if i may shop around for other estimates in his area you know check out other body shops and he planely refused. He wants me to go to the most expensive body shop (the dealership) on his 2004 vehicle model.. i wanna pay him for the damages not get ripped off and pay for a rainy day. i showed the pictures i took and their estimate they sent me to about 8 or 9 different mechanics and body shops and they all quoted me within the 800-1300 dollar range for both bumpers which is acceptable and i'd pay it to settle it with him.. he refuses and wants to go through a dealership he is now blackmailing me saying if i don't pay him his 2200 dollars by friday he will report me to the collision centre and go through insurance. it's been 8 days since the accident and neither of us reported it to the police or any collission centre or insurance... because we thought we'd settle this with ourselves... In Ontario you MUST report a collission within 78 hours i think to the police if damages over 500 dollars and injuries there were no injuries in our case and my dmg i thought at the time was 200 dollar job i got a quote back for 700.. We are both in trouble and have broken the law by not reporting will he actually go to his insurance and repotr a collision 8 days after? wont' they ask him why he didn't do it right away?? is he in equal trouble as I am? i need help on what to do.. should i suck it up and pay him the 2200 bucks? or let him go through insurance and face the penaltys of not reporting a collission.?? i'm supposed to leave the province in a couple days so i dunno how to deal with this!!! ALSO OF NOTE i am not insured.. i was driving my parents car under their insurance (which i am not apart of) and i also noticed on the quote he game me he doesn't have insurance either.. he was driving his girlfriends car and it's registered and insured under HER name.. he was in the car alone with a G2 does that help at all?? it came at the worst time sorry for the long post stupid me i signed a paper at the scene that he wrote saying i would pay for the damages.. i didn't think he would take advantage and blackmail me to get the best out of me.... i also got him to sign a paper saying not to go through insurance is that helpful at all?

Answer: Well your responsibility from the eyes of the insurance company is the rear of the car, the part you hit. His responsibility is the front of the car, regardless of you causing the accident. You have insurance for a reason, its to leagally protect your rights. Regardless of the cost of the accident always go through your insurance company. They have legal counsel on retainer. That is what you pay for. Not sure what the laws are in Canada. As far as the paper goes, in the US it's only a valid contract if consideration is exchanged. Consderation being something of value. For instance, you can't just pull out a piece of paper and write something like, "I agree to jump in the air", and two people sign it. So in your example: Party A agrees to pay damages to car owned by Party B (make, model, color, etc) in the amount of $1,500 and not to exceed $2,000 is an acceptable contract. Party A agrees to pay for damages to Party B's car. May not hold up in court. There are a lot of factors that go in to a binding contract. Just signing a paper that you agree to something isn't really enough, but it also depends on what is written on the paper.

Answer: Short answer: you're screwed. Your pictures mean nothing as you failed to realize that structural damage/non-cosmetic damage can occur which can only be discovered by trained personnel doing a inspection of the underside. The fact he has a G2 is meaningless. You may not owe him for the damages buy you'll certainly owe his girlfriend, the owner of the vehicle, for damages. The fact neither of you reported the accident to the police is also meaningless in the scope of your liability for damages you caused. In the end the owner of the vehicle chooses where they want to get their vehicle repaired. They're under no obligation to obtain another quote. It's up to you to prove the work required is excessive or unnecessary (i.e. you'll need a mechanic to say the work is unnecessary, not you saying it's unnecessary). Your parents insurer may still agree to cover the loss (although signing the paper saying you'll pay for damages is a big no-no). All you can now is have your parents report the accident to their insurer and see what happens. Either that or pay the $2,200.
