Good Luck! ![]() Question about car accident and insurance-Toronto, ON.?Question: Last week some woman reversed into my car on the road at an intersection. She had gone too far in the intersection and when she saw the other traffic light turned green and the cars approaching, she panicked and put her car in reverse and banged into my car behind her. First, when I tried to deal with her she kept her window closed and would not respond to me. I called the police and the officer came.. judging by the position of the cars, he could not make a proper report because it could have been that I hit her from behind... he made a report that both vehicles were at speed 0 and told me to call my insurance company and let them know what happened. Now I find out that woman has made a claim through her insurance and stated that it was ME who hit her from behind.. she has also stated that she got injured and when I spoke to a person from my insurance company, she informed me that they are still waiting on the police report made by the officer at the scene before they can proceed any further with her claim. I explained to my insurance company what really happened and the lady said "we're sorry, but rules are rules and our hands are tied". Apparently, insurance companies look at it as the person who was behind's fault (which was me in this case) and do not really "assume" someone could have reversed and hit.. anyways, my question is, what do I do in this situation? Firstly, this woman was extremely rude to me at the scene of the accident. I was being very polite knowing that she hit my brand new 5 series BMW. Secondly, she has now made this false claim to her insurance company about me hitting her from behind and about the false injuries and lastly, it does not look like my insurance company is going to even consider my side of the story as I was behind her. Any suggestions? I have spoken to a friend who is a little familiar with this and informed me that she cannot possibly get anything for "injuries" when the police report clearly states that both vehicles were almost at 0.. how does someone get injured at that speed? I am going to be speaking to a lawyer but before I do that I wanted to know if anyone here can give me a little advice?
