When you file a auto claim to fix your car with the insurance company how long do they have to fix your car?

Question: I filed the claim a month ago and still they're messing around. I live in Georgia. I need to fix my car. Can they hold back how long they want? The insurance damage guy just looked at my car Friday tho, and he said someone would contact me this Monday, but still, do you think I should call them back. Because I can't go another week with broken tail light and messed up bumper, may get a ticket

Answer: I would call them and advise that LEGALLY your vehicle CANNOT be driven due to the fact that you have a broken tail light. You need to know when the check will be issued so you can get your vehicle fixed. If you do not get a response or they "mess around" with you some more, then you advise that you want to speak to a supervisor. Advise the supervisor that this has been ridiculous that it has been a month and still no check has been issued for the damage to be repaired. Let them know that your vehicle is legally NOT drivable since you have a broken tail light. If you believe they are not appropriately handling your claim you always have the right to turn them into the Insurance commissioner or the State's Department of Insurance. ** just a little hint, most of the time insurance companies do not like that threat, and if absolutely necessary you can advise that you will turn them into the Insurance commissioner, but you should follow through with that threat ONLY if they do NOT respond appropriately or timely (or are just not handling your claim right)




Car Insurance not Paying (in Georgia)?

Question: I was in an accident three weeks ago. It was the other car's fault. There were no injuries. We didn't call the police, but I got a written statement from the other driver admitting fault. I got her car and insurance information and filed a claim with her insurance. They sent an appraiser and I got an estimate for the damages. So all that is left now is for the insurance to approve the estimate and send me a check. I have called the insurance company almost everyday since I got the appraisal (about 2 weeks ago) and they are saying that they are waiting to get in touch with the policy holder; apparently they don't have her correct phone number. But they have the signed statement from her admitting fault. The agent in charge of my claim doesn't even pick up the phone or return my calls, I just talk to the operator who can't really give me any answers. I have the basic car insurance, I don't have collision coverage, so I haven't even called my own insurance. My car is operational but my rear susspension is gone, and the bent metal is hitting my tire; I really need my car rapaired asap. Should I call a lawyer even though there were no injuries? I should probably add that my car is not worth much, but I still need it fixed! and I can't afford (don't want either) to pay for repairs out of my pocket. What should I do? Answer: Your best option is to call the Georgia Insurance Commissioner's office. It's one of those "If your question is about auto insurance, press 1" kinda switch boards...so you've got to be patient. One problem you might have is that...if your car is not worth much, they might just total it out and pay you only a small fraction of what it's actually worth. That happens sometimes with older cars...they cost more to repair than they would be worth. One problem you're going to have is that you can't PROVE that the person's signature is actually theirs. It would really have been better if you had called the police and gotten an official accident report stating clearly that it was the other car's fault. I hope that doesn't keep you from being able to collect, but you might actually have to get a lawyer and sue. Good luck...hope it gets worked out soon.




Will the insurance company cover my accident on a rental car?

Question: What happen if i rent a car in my friends name and take it out of state but use my dad's insurance card? I am only 19 and live with him. I am not adding my name as the secondary driver at the rental place. If i get in a accident in a different state will my dad's insurance cover the accident. And i can't rent in my dad's name. So that's out of the option. I am renting in Georgia and going to Florida. Thank you

Answer: If you rent a car in your friend's name, then your friend is renting the car. If you are not named as a driver, the rental company can hit your friend with extra fees that should have been charged. If CDW was purchased, you would not be covered as you are not a named driver. Also, most car companies won't rent to people under 25. So, you and your friend may have some big civil issues that you'll have to contend with when the rental car company finds out. Also, it's possible that your friends insurance won't cover the damage to the car and neither will your dad's insurance and neither would the benefits of the credit card used (some credit cards cover rental car damage). If you rent a car and have an accident, regardless of fault, you better have collision and comprehensive of sufficient value to cover the damages. If you have a cheap car at home that's worth $10,000, but you rent a $80,000 luxury car, your insurance will only cover up to the value of the car at home unless you buy a rider for the increased value of the rental. VISA's site below gives a host of restrictions that you would violate should you have an accident. And believe me, Murphy's Law will come into effect.




Which State am I a Legal Resident of?

Question: My driver's license and voter registration is in Georgia and I rent a room from my sister there. I own a home in Alabama and spend much time there. I pay state taxes in both states. My health insurance is with a Georgia company. My cars and car insurance are in Alabama. I have a motor home and spend most winters in Key West. The auto insurance company says they could not care less but the health insurance people have a problem with my residency. Of which state am I a "legal" resident?
